The Common Council met in a special session at City Hall in the City of Black River Falls on May 15, 2019 at 6:00 P.M. Alderpersons Olson, Busse, Gearing-Lancaster, Ross, Johnson, and J. Rave were present. Alderperson Brown was absent and Alderperson M. Rave was excused. Mayor J. Eddy presided.

It was moved by Alderperson Johnson, seconded by Alderperson Ross to dispense with the reading of the minutes of the May 7, 2019 Common Council meeting and approve as presented. Motion carried.

COMMITTEE REPORTS
It was moved by Alderperson J. Rave, seconded by Alderperson Olson to place on file the minutes of the May 9, 2019 Hiring Committee meeting. Motion Carried.

The Department Head monthly reports were reviewed. Department heads present were Steve Peterson, Tammy Peasley, Jody Stoker, Greg Rush, Steve Schreiber, and Brad Chown.
1. The Fire Chief presented his proposal to upgrade all new and replacement fire hydrants to 5” Storz steamer connection.
2. It was moved by Alderperson Busse, seconded by Alderperson Ross to approve the Fire Chief’s request to upgrade all new and replacement fire hydrants to 5” Storz steamer connection. Motion carried.
3. The EMS Division Chief presented information related to the ten (10) EMS action items on the agenda including new and revised job descriptions, the elimination of the ambulance driver position and job description, and new & revised policies and procedures for the EMS Handbook.
4. It was moved by Alderperson Ross, seconded by Alderperson Johnson to approve the EMR Job Description. Motion carried.
5. It was moved by Alderperson Johnson, seconded by Alderperson J. Rave to approve the revised EMT Job Description. Motion carried.
6. It was moved by Alderperson Busse, seconded by Alderperson Gearing-Lancaster to approve the AEMT Job Description. Motion carried.
7. It was moved by Alderperson Johnson, seconded by Alderperson Ross to approve the PARAMEDIC Job Description. Motion carried.
8. It was moved by Alderperson Ross, seconded by Alderperson Gearing-Lancaster to approve revised EMS Policy 1.1.060 Compensation. Motion carried.
9. It was moved by Alderperson Johnson, seconded by Alderperson J. Rave to approve revised EMS Policy 2.1.040 Training. Motion carried.


10. It was moved by Alderperson J. Rave, seconded by Alderperson Gearing-Lancaster to approve EMS Policy 2.1.120 Controlled Substances. Motion carried.
11. It was moved by Alderperson Johnson, seconded by Alderperson Ross to approve EMS Policy 1.1.120 SOG Revisions / Additions. Motion carried.
12. It was moved by Alderperson Johnson, seconded by Alderperson J. Rave to approve the elimination of the EMS Ambulance Driver position and job description. Motion carried.
13. It was moved by Alderperson Ross, seconded by Alderperson Johnson to approve the EMS Handbook change eliminating Section III and replacing it with separate Pre-Hospital Medical Guidelines. Motion carried.
14. The Street Superintendent advised the Council the department has a candidate for the vacant general laborer position pending pre-employment screenings. Inquiries from Alderpersons Gearing-Lancaster and Ross in regards to the possibility of placing a yield or stop sign at Buchanon Street and S. 5th Street will be addressed with the Chief of Police and brought back to Council if appropriate.
15. It was moved by Alderperson Olson, seconded by Alderperson Johnson to award the 2019 street paving bid to Oium Asphalt Paving, Inc. in the amount of $110,145.00. Motion carried.
16. The Parks & Recreation Director updated members on the community garden. Discussions have been ongoing with a few ideas on the table, but it comes down to cost and how to fund any proposed changes.
17. It was moved by Alderperson Busse, seconded by Alderperson Gearing-Lancaster to award the roofing bid for the cabin at Peterson Park to Simmons Roofing in the amount of $10,200.00. Motion carried. 2019 Parks & Recreation Capital Budget funds will be used for this project.

It was moved by Alderperson J. Rave, seconded by Alderperson Ross to approve the applications for a Liquor Operator’s License from Teresa L. Myher, Jack K. Haldeman, Jenna M. Kronebusch, and Melissa M. Swallow. Motion carried.

Patrick Murphy, agent and owner of Murphy’s Pub located at 123 Main Street, presented the Council with a letter outlining the conditional surrender of the liquor license for Murphy’s Pub so it could be applied for and granted to Dan Carpenter to lease the property and operate a restaurant and bar at the same address.

It was moved by Alderperson Olson, seconded by Alderperson J. Rave to approve the application for Class B Beer and Class B liquor License to The Comeback Sports Bar & Grill located at 123 Main Street. Motion Carried (5-1) with Alderperson Johnson voting no.

It was moved by Alderperson Busse, seconded by Alderperson Gearing-Lancaster to approve ORDINANCE 845 – an ordinance rezoning Lot 9 and part of Lot 7 of CSM No 4066 from B-5 Shopping Mall District to RD Rural Development District. Motion Carried.

CITY OF BLACK RIVER FALLS ORDINANCE NO. 845 AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF BLACK RIVER FALLS, JACKSON COUNTY, WISCONSIN, BY REZONING LAND
Pursuant to a public hearing held on May1, 2019, in accordance with the provisions of Wis. Stat. Section 62.23(7)(d)(2), and pursuant to the recommendation of the Plan Commission for the City of Black River Falls, Jackson County, Wisconsin: The Common Council of the City of Black River Falls, Jackson County, Wisconsin, do ordain as follows:
SECTION 1. Zoning ordinance amended. The following described properties, which are currently zoned B-5 Shopping Mall District, are hereby permanently zoned as RD Rural Development District:
(1) All of Lot 9 of Jackson County Certified Survey Map 4066, located in the Southwest 1/4 of the Southwest 1/4, Section 11, Township 21 North, Range 4 West, City of Black River Falls, Jackson County, Wisconsin; AND
(2) Lot 7, Jackson County Certified Survey Map 4066, located in Government Lots 7 and 8, and in the Southwest 1/4 of the Southwest 1/4, Section 11, Township 21 North, Range 4 West, City of Black River Falls, Jackson County, Wisconsin EXCEPT that part of said Lot 7 described as follows: Commencing at the West 1/4 Corner of said Section 11; thence N 89°34'00" E, along the North line of Government Lot 7, 1355.89 feet to the Northeast corner of the Northwest 1/4 of the Southwest 1/4; thence S 16°47'35" W, 351.82 feet to the Northwest corner of Lot 9 of said Map; thence S 22°59'05" W, along the Northwesterly line of said Lot 9, 358.77 feet to the West corner of said Lot 9; thence S 01°30'24" W, along the West line of said Lot 9, and also along the West line of said Lot 7, 222.69 feet to the POINT OF BEGINNING; thence continuing S 01°30'24" W, 696.43 feet to the Southwest corner of said Lot 7; thence N 73°13'01" E, along the South line of said Lot 7, 769.24 feet to the Southeast corner of said Lot 7; thence N 82°45'33" W, along an easterly line of said Lot 7, 380.27 feet to a corner of said Lot 7; thence N 33°21'18" W, along an easterly line of said Lot 7, 525.59 feet to a corner of said Lot 7; thence S 76°04'33" W, 53.52 feet to the POINT OF BEGINNING.

SECTION 2. Severability. The provisions of this Ordinance shall be deemed severable and it is expressly declared that the Common Council would have passed the other provisions of this Ordinance irrespective of whether or not one or more provisions may be declared invalid and if any provisions of this Ordinance of the application thereof to any person or circumstances is held invalid, the remainder of this Ordinance and the application of such provisions to other persons or circumstances shall not be affected thereby.
SECTION 3. Conflicting ordinances. Ordinances or parts of ordinances in conflict with the above Ordinance are hereby repealed.
SECTION 4. Effective date. Upon passage and publication, this Ordinance shall take effect and be in force as provided by law.
