The Common Council met at City Hall in the City of Black River Falls on November 15, 2017 at 6:00 P.M. Alderpersons Redbird, Colloton Chrest, Erickson, Olson, Busse, Gearing-Lancaster, and Ross were present. Alderperson Rave was excused. Mayor Jay Eddy presided.

It was moved by Alderperson Olson seconded by Alderperson Redbird to dispense with the reading of the minutes of the November 7, 2017 Common Council meeting and approve as presented. Motion carried.

Mayor Eddy opened the public hearing on the proposed 2018 City budget. The City Administrator explained there were changes to some library budget line items but they do not change the total annual budget for the library.

It was moved by Alderperson Ross, seconded by Alderperson Redbird to close the public hearing on the proposed 2018 City budget. Motion carried.

It was moved by Alderperson Erickson, seconded by Alderperson Olson to approve the 2018 City budget and set the tax levy at $2,024,395. Motion carried.

DEPARTMENT REPORTS
The Department Head monthly reports were reviewed. Department heads present were Todd Gomer, Kelly Bakken, Steve Peterson, Tammy Peasley, Steve Schreiber, Jody Stoker, and Brad Chown.

Patrol Officer Dean Taylor addressed the Council announcing his retirement effective December 22, 2017. Officer Taylor has been with the city for 23 years and thanked the Council for the opportunity to work in this city and raise his children here. Dean commended the council for selecting Kelly Bakken as the new Chief of Police. The Council and fellow department heads applauded Officer Taylor and his length of service to the community.

It was moved by Alderperson Busse, seconded by Alderperson Olson to approve Police Department Policy 4.011 Brady Material Disclosure. Motion carried.

It was moved by Alderperson Gearing-Lancaster, seconded by Alderperson Redbird to approve Police Department Policy 5.009 Medical Aid and Response. Motion carried.

It was moved by Alderperson Redbird, seconded by Alderperson Ross to approve the EMS request to purchase a 2018 John Deere XUV825M S4 from Tractor Central for $18,250.00 and to send the UTV to Stainless & Repair in Marshfield, WI for rescue body for an additional $28,235.00. Motion carried.

There was discussion on Viva Cinco De Mayo’s application to transfer their liquor license to a new location. Sharon Trujillo, owner of the building currently occupied by the restaurant addressed the Council expressing her opposition to the transfer. Trujillo feels the license should stay with the building that she owns, maintains, and pays taxes on. The City Administrator and City Attorney explained that alcohol licensing is regulated by state statutes and not by local ordinances or laws. According to state law, the license is issued to the business and its agents not the location and therefore the license can be transferred from premise to premise.

It was moved by Alderperson Ross, seconded by Alderperson Colloton Chrest to approve Viva Cinco De Mayo Mexican Restaurant’s application for transfer of license for sale of fermented malt beverages and intoxicating liquor from 24 North Water Street to 109 Main Street on or about March 2018. Motion carried (6-0-1) with Alderperson Erickson abstaining.

It was moved by Alderperson Busse, seconded by Alderperson Gearing-Lancaster to table RESOLUTION 2017-14 until the December 5, 2017 meeting. Motion carried.

Alderperson Redbird addressed the Council regarding November being Native American Heritage Month. There was interest in having presentations scheduled for future meetings.

It was moved by Alderperson Ross, seconded by Alderperson Redbird to approve vouchers for October 2017 check #63213 - #63323 totaling $343,340.49. Motion carried.

It was moved by Alderperson Redbird, seconded by Alderperson Gearing-Lancaster to approve the City Treasurer’s Report for October 2017. Motion carried.

It was moved by Alderperson Gearing-Lancaster, seconded by Alderperson Ross to approve Revenue & Expense Reports for October 2017. Motion carried.

It was moved by Alderperson Busse, seconded by Alderperson Redbird to adjourn in to closed session for the purpose of deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session which is authorized by Section 19.85(1)(e) of the Wisconsin Statutes. Motion carried.
